Privacy Policy

This Privacy Policy explains how RX Plastics Pty Ltd (trading as RX Rims) ABN 39 009 787 688 (we, us, our) collects, holds, uses, discloses and protects your personal information. We are a manufacturer and supplier of plastic products, selling to both business and consumer customers, offering credit accounts and operating an online store.

We are committed to protecting your privacy and to handling your personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs). Where we collect, hold, use or disclose credit-related information, we also comply with Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code (CR Code).

This Policy applies to personal information we collect through our website and online store, over the phone, in person, in writing and through our dealings with you as a customer, supplier or credit applicant.

1. The kinds of personal information we collect and hold

The kinds of personal information we may collect and hold include:

  • your name and the name of the business you represent;
  • contact details, such as your postal address, email address and telephone numbers;
  • delivery and billing details;
  • payment details, such as credit or debit card and bank account information;
  • business and Australian Business Number (ABN) details;
  • credit information, where you apply for or hold a credit account with us (see the Credit information section below);
  • details of your orders, transactions, enquiries and dealings with us; and
  • website and usage data (such as your IP address, browser type and pages visited, and other information collected through cookies and analytics tools) where this information is about you or can reasonably identify you.

We do not generally collect sensitive information. If we need to collect sensitive information, we will do so only with your consent or as otherwise permitted by law.

2. How we collect personal information

We collect personal information in a number of ways, including:

  • directly from you, when you contact us, place an order, open an account or otherwise deal with us;
  • through our website and online store, including through online forms and cookies;
  • over the phone; and
  • from third parties, such as credit reporting bodies and trade referees, particularly when assessing an application for a credit account.

Where it is reasonable and practicable to do so, we will collect your personal information directly from you. If we collect your personal information from a third party, we will take reasonable steps to make sure you are aware of the matters listed in APP 5.

3. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for purposes including:

  • to supply our goods and services to you;
  • to manage your account, orders and deliveries;
  • to process payments and manage our accounts and records;
  • to assess applications for credit accounts and to manage and administer credit we provide to you;
  • to provide you with marketing information about our products and services, where you have consented or where it is otherwise permitted (see the Direct marketing section below);
  • to meet our legal and regulatory obligations;
  • to recover debts owed to us; and
  • to respond to your enquiries and to otherwise communicate with you.

4. Who we disclose personal information to

We may disclose your personal information to:

  • service providers who assist us in operating our business, such as delivery and logistics providers, payment processors and IT service providers;
  • credit reporting bodies, in connection with assessing and managing credit accounts;
  • our professional advisers, such as accountants, auditors and lawyers;
  • debt collection agencies, where necessary to recover amounts owed to us; and
  • government agencies, regulators, courts and other bodies where we are required or authorised to do so by law.

5. Credit information

Where you apply for or hold a commercial credit account with us, we may collect, hold, use and disclose credit-related information under Part IIIA of the Privacy Act and the CR Code. The credit reporting body we use is Equifax. Equifax's privacy policy is available at https://www.equifax.com.au/privacy.

The credit information we may collect and disclose to Equifax includes:

  • identification information, such as your name and address (and, where you are a sole trader, director or guarantor, other identification details you provide on your credit application);
  • details of your credit applications and the type and amount of commercial credit you have applied for or that we provide to you;
  • information about your commercial credit account with us, including the credit provided, your credit limit and the conduct of your account; and
  • default and overdue payment information, where you fail to meet your payment obligations.

We may also obtain from Equifax credit eligibility information about you, such as a credit report, credit score or credit assessment. We use this information only to assess your application for credit and to manage the credit we provide to you. We do not disclose credit eligibility information except as permitted under Part IIIA of the Privacy Act and the CR Code.

Disclosure of default or overdue payment information. If you have a commercial credit account and fail to meet your payment obligations, we may disclose this to Equifax, and that information may be included in reports Equifax provides to other credit providers to assess your creditworthiness.

Your rights in relation to credit-related information. You may:

  • obtain a copy of your credit report from Equifax free of charge once every 12 months, and free of charge within 90 days of being refused credit or of having credit-related information corrected;
  • request correction of credit-related information we or Equifax hold about you, at no charge. We will deal with a correction request within the timeframes required by the CR Code (generally 30 days), and will consult with Equifax and any other relevant party as required;
  • ask a credit reporting body not to use your credit-related information for the purposes of direct marketing or the pre-screening of direct marketing offers; and
  • ask a credit reporting body not to use or disclose your credit-related information if you believe you have been, or are likely to be, a victim of fraud (including identity fraud).

6. Direct marketing

From time to time we may use your personal information to send you marketing information about our products and services that we consider may be of interest to you. We will only do so where permitted by law and, where required, with your consent.

You can opt out of receiving marketing communications from us at any time by using the unsubscribe facility included in our electronic messages, or by contacting us using the details in the Contact us section below. Once you opt out, we will stop sending you marketing communications within a reasonable period.

We do not use or disclose your personal information for the purpose of direct marketing by other organisations without your consent, except as permitted by law.

7. Overseas disclosure

We are not likely to disclose your personal information to overseas recipients. Our systems are hosted in Australia. If it becomes necessary to disclose personal information to an overseas recipient, we will take reasonable steps to ensure that the recipient handles your personal information in accordance with the APPs, consistent with our obligations under APP 8.

8. Data security and the Notifiable Data Breaches scheme

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include physical, technical and administrative security measures, and restricting access to personal information to those who need it to perform their duties.

We will take reasonable steps to destroy or de-identify personal information when we no longer need it for any purpose for which it may be used or disclosed, unless we are required by law to retain it.

We comply with the Notifiable Data Breaches scheme under the Privacy Act. If we suspect a data breach involving personal information we hold may be an eligible data breach, we will assess it, generally within 30 days. Where we are required to do so, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC). Where a breach involves credit-related information, we will also handle it consistently with our obligations under Part IIIA of the Privacy Act.

9. Access and correction

You may request access to the personal information we hold about you, and ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, please contact us using the details in the Contact us section below.

There is no fee for making a request to access your personal information. A reasonable fee may apply to giving you access, and we will let you know of any such fee before proceeding. We will not charge you for correcting your personal information. We may need to verify your identity before providing access.

We will respond to your request within a reasonable time. If we refuse to give you access or to correct your personal information, we will give you reasons in writing, except where it would be unreasonable to do so. If we refuse to correct your personal information, you may ask us to associate with it a statement that you believe the information is inaccurate, out of date, incomplete, irrelevant or misleading, and we will take reasonable steps to do so.

10. How to make a privacy complaint

If you have a complaint about how we have handled your personal information, please contact us using the details in the Contact us section below. We will acknowledge your complaint and respond within a reasonable time.

If your complaint relates to credit-related information, we will deal with it in accordance with the CR Code. We will generally give you a written response within 30 days, and will let you know if we need more time.

If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC). You can contact the OAIC by visiting https://www.oaic.gov.au or calling 1300 363 992.

11. Cookies and website analytics

Our website uses cookies and similar technologies to help it function properly, to remember your preferences and to collect analytics information about how our website is used. This information helps us to improve our website and services. Most web browsers allow you to manage or disable cookies through your browser settings, although some features of our website may not work correctly if you do so.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. The current version will always be available on our website at https://rxrims.com.au, and the effective date and version number above will be updated when changes are made.
